Protecting Children from Involuntary Psychiatric Examination

Just in Florida there were over 36,000 children sent for involuntary psychiatric examination during fiscal year 2017-2018

This violation of human rights is happening to children as young as six years of age who are being sent for involuntary psychiatric examinations, called a Baker Act, without parental knowledge.

It is the opinion of CCHR that before a child is sent for an involuntary psychiatric examination that a parent or guardian should be brought into the process and given the opportunity to help their child as is their right.

Children and youth

It is a fundamental right of parents to direct the upbringing, education, and care of their minor children. The U.S. Congress has decreed that based upon the Constitutional rights and human rights of all citizens, important information relating to a minor child should not be withheld, either inadvertently or purposefully, from his or her parent, including information relating to the minor child’s health, mental health, well-being, and education.

However, many parents do not know and understand their rights so CCHR created a booklet as well as online resources and seminars as a guide for Florida parents and are making these rights widely known to parents across the state.
