Our programs
What are the organization's current programs, how do they measure success, and who do the programs serve?
Co-Counseling Program
NILA takes a hands-on approach to training and mentoring immigration attorneys seeking to improve their federal litigation capacity. We believe in learning by doing and that attorneys are stronger together. We understand that federal court can be daunting for those who have never filed a case, and even for more experienced attorneys who may be filing a new type of federal court case. To that end, NILA staff co-counsel federal court cases, allowing existing immigration counsel to learn litigation skills while simultaneously having the legal expertise and support to present the strongest case possible. Our co-counseling docket includes petitions for review, habeas corpus petitions, district court actions challenging agency delay, circuit court appeals, Federal Tort Claims Act claims, individual Freedom of Information Act lawsuits, rehearing petitions, and attorneys’ fees motions. Impact Litigation Program
NILA’s impact litigation work includes affirmative district court litigation that seeks procedural or substantive change, either to extend the rights of noncitizens or to eliminate systemic obstacles they or their immigration counsel routinely face. For example, NILA has litigated and/or is litigating nationwide class actions related to access to immigration cases files, work authorization for asylum seekers and people applying for Temporary Protected Status, bond hearings for detained asylum seekers, and expedited processing of petitions to reunite refugee families. Our impact litigation also includes amicus briefing to assist federal court judges in their consideration of key legal issues.
Transparency Litigation
NILA’s transparency litigation focuses on lawsuits under the Freedom of Information Act (FOIA), seeking records that federal agencies have failed to disclose and shrouded from public view. NILA’s transparency litigation includes litigation seeking policy records which will benefit immigration attorneys and immigrants' rights advocates, all of which we then post on our website. For example, we are currently litigating cases seeking records related to refugee petition adjudications, records related to assaults and misconduct by immigration officers, and policies regarding deportations to non-designated countries of persons who have won protection from their country of origin. Some of our transparency cases are part of our co-counseling program. Please see our website for a listing of current cases.
Strategic Assistance and Pleading Review Programs
Attorneys can become NILA members and receive unlimited, one-to-one strategic assistance from our staff on their cases. Our annual membership rate is $250 for private attorneys and $125 for nonprofit attorneys. Membership also comes with priority for our Co-Counseling program, discounted rates for NILA-hosted webinars, and free welcome and end-of-year litigation resources intended to make it easier for our members to litigate immigration cases in federal court. In addition, depending on our availability and for a reasonable extra fee, NILA members can access our Pleading Review Program whereby NILA staff review and provide high-level comments and/or edits on pleadings in individual cases.
NILA Webinars
New in 2023, NILA hosts scheduled bi-monthly webinars for Continuing Legal Education credit as well as late-breaking webinars on new legal developments. Executive Director
Trina Realmuto
With over twenty-five years of experience in immigration and accountability litigation, Trina has litigated several precedent decisions on behalf of individuals, classes, and amicus curiae, written numerous practice advisories, and is a frequent presenter on immigration issues. From 2017 to 2020, Trina was Directing Attorney of Litigation at the American Immigration Council (AIC). Prior to that, she served as the Litigation Director of the National Immigration Project of the National Lawyers Guild for eight years and as a consulting attorney to AIC for six years. She also has worked abroad representing noncitizens applying for visas at U.S. embassies and consulates. Trina began her career as an associate attorney at Van Der Hout LLP in San Francisco. In 2015, Trina was awarded the Jack Wasserman Memorial Award for Excellence in Litigation by the American Immigration Lawyers Association.
